Description of a research project

The GEMSS project - Liberties in the Information Society Unit


The introduction of the GRID technology in the healthcare sector represents a huge challenge.

It concerns a new computing technology participating to the provision of healthcare services or to the completion of scientific research, mostly by providing huge computing and memory resources, possibly Internet based.

The first projects deal with medical imaging, medical tele-assistance, medical or pharmaceutical research, human genomic studies, creation of databases for therapeutic, scientific, statistical or epidemiological purposes.

The GEMSS project aims at testing the European legal framework to know if it supports the use of such technologies in the healthcare sector.

Three approaches have been selected with respect to this:
- processing of personal data for medical purposes or for scientific research,
- contractual aspects of the provision of such services,
- liability and ethical issues.


At this stage of the project, the main results are :
- the provision of the GEMSS services is a sub-processing of personal data in view of Directive 95/46. The data controller has to choose a processor complying with special requirements.
- the contractual aspects depend on several rules of conflict of laws of different nature. It doesn't facilitate the writing of a contract for the provision of such service on a day-to-day and low-cost basis.
